SERVICE AND MAINTENANCE
The supplier shall provide the Customer with a complete service and maintenance guarantee which will ensure satisfactory operation of the Equipment, covered by this Agreement.
The Supplier shall
Based on the specific needs of individual Equipment, inspect, lubricate and adjust the Equipment (hereinafter called “Preventive Maintenance”) to ensure the Equipment is in good working condition. The frequency of Preventive Maintenance is stated under Schedule of Equipment.
Dispatch a trained service technician/engineer to attend to any breakdown of the Equipment (hereinafter called “Corrective Maintenance”). Provide Corrective Maintenance under normal circumstances within a certain period (hereinafter called “Response Time”) after receiving the service call. The Response Time of Corrective Maintenance is stated under Schedule of Equipment.
Provide the service and maintenance during the Principal Period of Maintenance.
At the request of the Customer, provide Corrective Maintenance during the Extended Period of Maintenance.
Provide loan of a compatible and good working Equipment if repair period exceeded two (2) working days after the initial visit.
Reserved the rights to re-collect defective parts after new replacement.
The Customer shall
Appoint authorized person to operate the Equipment.
Not permit any person not authorized by the Supplier to tamper/repair on the Equipment.
Inform the Supplier, if the Customer wishes to remove the Equipment form its original address of installation to another location, such re-location can be carried out by the Supplier upon the Customer’s request at a mutual agreeable charge.
Provide on request a suitably informed representative, agent or employee to accompany the Supplier’s service technician/engineer to ensure the service and maintenance of the Equipment is performed effectively.
Provide a secure and adequate facility in reasonable proximity to the Equipment for the storage by the Supplier of tools and other items necessary for the proper service and maintenance of the Equipment.
Permit the Supplier to have access to such storage facilities at all reasonable times including, but not limited to, all times during the Customer’s normal business hours.
The Customer is also responsible in arranging for any form of permit for the Supplier, from the authorized party, so as the Supplier would be able to carry out his work without delay.
The Supplier shall not be responsible to provide service and maintenance for the breakdown of the Equipment (unless, additional charges and subject to the Supplier’s terms and conditions) resulting from:
Damage caused by negligence and/or misuse by the customer.
Damage caused by any tampering of the Equipment by any person other than the personnel authorized by the Supplier.
Damage caused by riot, lightning strike, fire, flood, explosion or any other acts of God.
Damage caused by transit from place of installation to another location by the Customer.
Damage caused by the use of supplies and parts other than that recommended by the Supplier.
Damage cause by electrical wiring, air-conditioning, building or environmental work external to the Equipment.
The service and maintenance provided by the Supplier under this Agreement does not cover the cost of the following items:
Electrical and cabling work external to the Equipment.
Changes or alterations in specifications of the Customer’s system.
Installations, re-location or removing of Equipment, devices or attachments.
Maintenance of accessories, attachments or other devices not listed in the Schedule of Equipment.
Rebuilding, overhauling or upgrading the Equipment.
Expendable and consumable supply items as listed in the Schedule of Equipment.
EXCLUSION CLAUSE
The obligation of the Supplier shall to provide service and maintenance on the Equipment to satisfactory operation, and in no event shall the Supplier be liable for any incidental, special or consequential damages arising from the loss of use of the Equipment, data or profits, whether arising form the carrying out of the service and maintenance or otherwise.
